I was wondering if this is up to code or if the vent has to be 6″ above overflow before running horizontal

That used to be legal, but on a recent job an inspector nailed me for doing it with a toilet vent. I think it is no longer code.
Yeah I looked a little closer at the plumbing code where I live and its not up to code
It's amazing how many dry, horizontal tub / shower vent pipes we discover during bathroom remodels, and most of the time the horizontal vent is plugged solid with accumulated hair, soap scum, etc..
There is always a way to connect fixture vent piping code correct including using wet venting, combination drain & vent, and up-sizing fixture drain piping.
