Hi. Asking for a friend but I hope someone can help.
She is opening a restaurant with a friend 50/50 but wants to trade under her brand name. She already does private catering and may want to branch out into other things in the future.
Can this be done? Or would her business partner in this restaurant own 50% of the brand name?
Nothing has been registered yet but she is planning to do so this week.

Put it in the partnership contract.
if she "owns" the brand she should be able to structure an agreement to license it to the partnership for a specified term under specified conditions. If the partnership dissolves, then she retains ownership. A lawyer would need to draft the agreement to comply with (primarily) state laws
