I will try to keep this short as possible. Give contractor in February $5,000 and sign a contract to begin building our home. Start date is May 1st – October 1st. Contractor says that he would like to start in April. Once it gets closer to May, contractor says it will be a few days before or after contract date. One week after contract starts, I have to call the contractor and ask for updates. This time, the concrete guy he uses is backlogged and has been for some time (something that was left out). Now we are at May 20th without breaking ground. I am aggravated I signed a contract for a set date and nothing has been done. In the contract it also states he is allowed to work on other jobs through our contract. Is this normal? Am I overreacting? I have talked to him a few times last week and he feels this week we will start digging, but I still don’t have an exact day. I am wondering if this is shady business or something that happens with contractors and new construction. I can only imagine he will start using weather as an excuse next to delay things further. Thanks for the help or input.

Sounds like he is in breach of the contract. In Calif. a $5000 down payment would not be legal. You need legal advice.
Agreed, lawyer up. Something has happened either in his life or in his relationships with his subcontractors.
