From the article, stating what subcontractors do and must abide by:
". . . file appropriate tax; perform specific services; incur expenses; assume liability; stay off the contractor's payroll; assume the risk of realizing a loss; have liabilities; and track revenue and expenses. "
That is all what subcontractors do in the world of commercial contracting.
But there is a lot of residential-work "subbing" done here in my part of NY that is really just hourly-rate-paying to those a "builder" hires but does not have on his payroll.
If enacted in NY, this fuzzy stuff would keep happening, in my opinion, because it will take a lot of bureaucracy to handle oversight and enforcement.
NY is practically insolvent now . . . I cannot see it doing this. I hope they can pay me my tax refund before they go belly up.

Kind of a dumb add, but it might actually be a legitimate job, with a poor job decription.<G>
Maybe we need to step back, and review what makes for each type of work.
The primary contractor - usually a general contractor - has the duty to see the job is done. He may contract with other contractors (subs) to accomplish this. He is responsible for providing jobsite necessities, scheduling, getting the subs paid. He can't do everything, though ... specialty trades (plumbing, electrical, fire sprinklers, etc.) require specialty contractors. These tasks usually require a separate permit, or for the specialty contractor to sign off on the prints. Integral to this last point - you can only work off your own prints; you can't change specialty contractors witout new drawings being submitted.
A contractor, of any type, is responsible for his own tax payments, getting necessary permits, workmans' comp insurance, etc. He has his own license feese, etc., to cover. Licenses are NOT optional.
Some guys try to avoid following employment rules by claiming that the employee is an "independent contractor." Every bureaucracy will have it's own criteria as to whether they consider someone 'independent' or not. Reno's largest taxicab company went out of business as a direct result of their trying to play with the workmans' comp and unemployment insurance laws in this manner - and that business had a hefty subsidy (they owned the land the town's richest casino sits on).
Employees need for their employer to pay their taxes, insure them, etc. Where there are licenses involved, the employer holds the license, and the employee is not considered qualified to operate on his own. Employees cannot pull permits.
Naturally, there are all manner of folks out there who try to rewrite these basic definitions to suit their own interests. The short version? They offer workmans' wages, without performing the duties of an employer. They are, in essence, asking for a contractor - but offering a fraction of a contractors' price. They are also usually making this 'offer' to folk who are not qualified to be contractors. Or, they seek out those that they consider desperate.
By offering cash, and insisting on buying parts themselves (from other than the usual places), they are attempting to protect themselves. They may also be setting the stage to screw you. No paperwork? No license? No insurance? Taxes not paid? They never heard of you. Owe you money? Try enforcing a lien - they're ready to deny you were ever on the job.

True enough .... you need to know the laws of your area.
Though there are often wide local variations, once you understand the general way of things, at least you know the right questions to ask.
I can't really say I'm surprised.
First ... remember that the "sheriff" was a position crested to collect the King's taxes! Never overlook that aspect of any regulation.
Second ... I was recently approached by a "general contractor" with a proposal that seemed designed to circumvent every law out there, and any responsibilities, that might apply to him. His arrangement would have me as neither contractor or employee. Such dishonest tactics only inspire greater governmental interference.
That following the rules oftem only means an additional burden on the law-abiding is a common complaint.
I suspect that the situation will continue to get worse. With the current opinions of the economy, and the government's response, I suspect that there will be a quantum leap in growth of the 'underground economy.'
Naturally, the primary result of this will be making victims of the naive - who will be easy marks for the crooks - and a golden opportunity for organized crime.
