I saw this one last week.
In April the painter bid a job for external painting and some wood repair for $2500, labor only. And the HO accepted and gave a $300 deposit for the job to be scheduled for August, but no exact date set.
Then next day the HO extended the job. Another $1000 was added and the HO signed the contract.
When the painter contacted the HO, about the end of July, for scheduling the HO asked if they could change the scope of work to only do the front.
The painter sent his a new estimate for $1500.
Painter called the HO to say that he had not gotten a signed contracted back and was ready to start. HO said that he had gotten another person to do the work.
HO sued for the return of his $300 deposit. Claims that the painter never gave his the refrences that he asked for.
Painter counter sues because he lost a week of work.
Judge says that the HO already signed contract. And if he wanted the references he should have never signed in the first place.
Painter not only kept the $300, but got another $300.
