I would assume that there was something in the covent and restrictions filed with the deed that covers this.
Interestingly. I clicked on this thinking of reading about shared road maintanance with the idea that deeds and covenants generally covered such issues.

I almost bought a duplex that needed a new roof and there wasnt any covenent that spelled out the roof quandry, the other party didnt want to cough up the dough for their half so I decided that if we couldnt come to a consenses on this issue then no need in me buying the property.

I would like to thank you , though I now have permission to re-roof both sections I did search the deed to the house and did find an interesting item on deed from 1883 that allows to trespass on or over the next property to repair and maintain.
I am allows amazed that I never stop learning.

I've seen duplexes several times with two different colored roofs (asphalt) . One on the left, one on the right . The shingles zig zag up and over the roof along the "property line" as best they can.
In this case the roof needs to be striped as it is over 100 years old with one layer of slate and 3 layers of asphalt, and the neighbour's roof the same. I will ask the home owner to look at her deed.
